This Agreement is between Ultralight Geospatial LLC (“ULGS,” “we,” “us”), an Oregon limited liability company, and you, the person installing or using TelCam (“you”). If you install or use TelCam for an employer or organization, you confirm you are authorized to accept this Agreement on its behalf, and “you” includes that organization.
You accept this Agreement by tapping I AGREE when TelCam first runs. If you do not agree to these terms, do not use TelCam; using TelCam without agreeing to them is unlicensed use. Refunds are handled by the store you bought it from, under that store's policies, not by us.
For TelCam obtained from the Apple App Store, see also section 17, which adds terms Apple requires.
TelCam is a telemetry and camera application. Telemetry and photograph data are received from your device's sensors, organized and displayed in TelCam's interface, and written into photographic outputs according to your settings. TelCam can also display and draw boundary outlines derived from public datasets or supplied to you.
On Android, TelCam declares no internet permission, contacts no service, and cannot transmit anything by itself. Section 17 describes the equivalent behavior on Apple devices.
TelCam is licensed to you, not sold.
We grant you a non-exclusive, non-transferable, revocable license to install and use TelCam on devices you own or control, for your own purposes, whether personal or business.
Your license is subject to your compliance with this Agreement and with the terms of the store you obtained TelCam from. Section 17 states the additional limits Apple requires on Apple devices.
Materials we supply. We may supply you with files for use in TelCam — boundary files, overlays, or other geospatial material, whether published by us or prepared for you on request. Unless we agree otherwise in writing, we grant you a non-exclusive, non-transferable license to use those files with TelCam for your own purposes, and we retain ownership of them and of the data, methods, and derived datasets behind them. You may not redistribute or resell them. Where a file we prepare for you incorporates material you supplied — your logo, your trademark, your data — that material remains yours, and our rights extend only to our own processing and formatting of it. Nothing in this paragraph applies to files you make or obtain yourself.

You must also comply with any third-party terms that apply to you when using TelCam, including your mobile carrier's and device manufacturer's terms.
We claim no ownership of, and take no license to, anything you create with TelCam. Your photographs and exports are yours. This Agreement gives us no right to use, copy, publish, analyze, or train on your content — we can only ever receive what you choose to send us, and what we do with that is described below. Files we supply for import are licensed under section 2; anything of yours inside them stays yours.
We take no path into your device or your data. TelCam is deliberately built with no network capability of its own — no internet permission, no cellular or Wi-Fi use. Neither we nor you can use TelCam to send your photographs or readings off your device; to share them, you use other apps of your choosing. We operate no servers for TelCam, hold no accounts, and receive nothing you capture. We commit to keeping it that way: if a future version of TelCam ever needs to send anything off your device, we will say so on the privacy policy page before that version ships, and this Agreement will be updated with it.
We control TelCam — what it does, how it is licensed, and what changes in each release. We do not reach past it. What else your device allows, and who else has rights over it, is between you and the makers of your device, your operating system, your carrier, the other apps you install, and your employer if they manage the device. We cannot speak for any of them.
If you choose to send us a diagnostic report, a photograph, or a file — by your own email, by your own action — we use it for the purpose you sent it: answering you, and diagnosing and fixing what it shows, for you and for other users affected by the same problem. The privacy policy at ulgeospatial.com/privacy.html describes how we handle anything you send.
TelCam records what your device reports. It does not measure position, heading, or elevation itself, and it does not improve what your device's sensors produce.
Readings can be wrong or imprecise. What your device reports is affected by, among other things:
Positions may come from satellites alone or, if you enable network-assisted positioning, from your device's own positioning service, which estimates location from nearby cell towers and Wi-Fi. Either way, the positioning is done by your device, not by TelCam. Other apps on your device may use different positioning sources or processing, and may show a position when TelCam does not, or a different one.
TelCam displays the accuracy figures your device's sensors report; marks a photograph NO FIX when no position is available rather than writing a position it does not have; and marks photographs whose position relied on network estimation. Displayed precision follows measured accuracy. None of this is a guarantee.
Boundary and map outlines. Boundary files come from public datasets, from data we create, or from data you supply. Where we have processed public data, the modifications are ours, and the agencies named as sources neither performed nor endorsed them. Outlines are for general reference. They are not a survey, and they do not establish any legal boundary or land ownership.
TelCam is a documentation and general-reference tool. Do not use it as the sole or authoritative source for:
Nothing TelCam produces is a licensed or legal survey product, or a document suitable for construction, recording, or conveyance. TelCam does not replace work by a licensed professional land surveyor or licensed engineer.
We do not warrant that any photograph, watermark, metadata field, timestamp, or exported file will:
If your use requires evidentiary weight, you are responsible for deciding what that requires and for putting it in place — retention, preservation of originals, access controls, custody records, verification, and anything else your circumstances demand.

TelCam includes a third-party typeface under its own license, reproduced in the app's ABOUT screen. The boundary datasets TelCam carries are listed in ABOUT with their source agencies, generated at build time from what that build actually contains. Those listings govern; this Agreement does not restate them.
We may release updated versions of TelCam. Updates may add, change, or remove features.
We may also amend this Agreement at any time, for any reason, at our discretion. An amendment takes effect for you when you run the TelCam release that carries it — we don't amend this Agreement by editing the posted copy alone. Running that release is your acceptance of the updated terms.
The current version is posted at ulgeospatial.com/telcam-eula.html so you can review it in advance of a release, and it's shipped inside the app so you can read it offline. The copy in your installed app is the version you accepted, and it continues to govern until you install a release carrying a newer one.
You may not use, export, or re-export TelCam except as United States law and the law of the place you obtained it allow. In particular, TelCam may not be exported or re-exported into any U.S.-embargoed country or region, or to anyone on any U.S. Government list of prohibited or restricted parties.

TELCAM IS PROVIDED “AS IS” AND “WITH ALL FAULTS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ULGS DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
ULGS DOES NOT WARRANT THAT TELCAM WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT ERROR OR INTERRUPTION, OR THAT ANY POSITION, HEADING, ELEVATION, ACCURACY FIGURE, TIMESTAMP, BOUNDARY OUTLINE, OR METADATA FIELD IT PRODUCES WILL BE ACCURATE, CURRENT, COMPLETE, OR SUITABLE FOR YOUR PURPOSE. YOU USE TELCAM AND ANYTHING IT PRODUCES AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ULGS IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS, LOST OR CORRUPTED DATA, LOST PHOTOGRAPHS, COST OF SUBSTITUTE GOODS OR SERVICES, REWORK, DELAY, REGULATORY CONSEQUENCES, OR THIRD-PARTY CLAIMS, EVEN IF ULGS KNEW OR SHOULD HAVE KNOWN SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ULGS'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR TELCAM SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR TELCAM OR US $50.
These limits apply whether a claim is brought in contract, warranty, tort including negligence, strict liability, or on any other basis, and apply to the maximum extent permitted by law. The exclusion of damages in this section is independent of any remedy stated elsewhere and survives even if a stated remedy fails of its essential purpose.
Nothing in this Agreement limits liability that cannot lawfully be limited, including liability for fraud or intentional misconduct, and nothing in this Agreement limits our liability to you beyond what applicable law permits.
You acknowledge that ULGS would not offer TelCam at its price without the warranty disclaimer and the limits in this section, and that these terms are part of what you are agreeing to in exchange for that price.
If your organization acquires TelCam licenses for its staff, your organization's purchase order terms, procurement terms, or supplier conditions do not apply to this Agreement unless ULGS accepts them in writing and signs them.
This Agreement runs until it ends. You may end it at any time by uninstalling TelCam and stopping use. Your license ends automatically if you breach this Agreement, and you must then stop using TelCam and remove it from your devices.
TelCam contains no license check and nothing by which we could disable it remotely. It cannot transmit anything by itself; anything that reaches us is something you chose to send from your own mail app. We have no way to switch off a copy you have installed, and we do not.
That is a statement about our software, not about your device. The store you obtained TelCam from, and the security software on your device, may have their own ability to remove or disable applications under their own terms. Those are not ours, and this Agreement does not change them.
Ending this Agreement does not delete your photographs. They are on your device and remain yours. Sections 3 through 9 and 11 through 18 survive.
This Agreement is governed by the laws of the State of Oregon, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute arising out of or relating to this Agreement or to TelCam shall be brought only in the state or federal courts located in Multnomah County, Oregon. You and ULGS each consent to the personal jurisdiction of those courts and waive any objection to venue there or any argument that they are an inconvenient forum.
Before filing, you agree to contact us at support@ulgeospatial.com describing the problem and what you want, and to allow thirty days for us to try to resolve it. This does not stop either of us from seeking an injunction to protect intellectual property rights.
Either of us may bring a qualifying claim in small claims court instead.
EACH OF US WAIVES ANY RIGHT TO A JURY TRIAL IN ANY ACTION ARISING OUT OF OR RELATING TO THIS AGREEMENT OR TO TELCAM.
Nothing in this section limits any right you have under a law that cannot be waived by agreement, including consumer protection law where you live.
This section applies only if you obtained TelCam from the Apple App Store. Apple requires it. Where it conflicts with another section of this Agreement, this section governs for App Store copies.
17.1 This Agreement is with us, not Apple. This Agreement is concluded between you and ULGS only. Apple is not a party to it. ULGS, not Apple, is solely responsible for TelCam and its contents.
17.2 Scope of your license on Apple devices. Your license is a non-transferable license to use TelCam on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions — except that TelCam may also be accessed, acquired, and used by other accounts associated with the purchaser through Family Sharing, volume purchasing, or Legacy Contacts.
17.3 Maintenance and support. ULGS is solely responsible for any maintenance and support for TelCam. Apple has no obligation whatsoever to provide maintenance or support for it.
17.4 Warranty. ULGS is solely responsible for any product warranties, express or implied by law, to the extent not effectively disclaimed. If TelCam fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation for TelCam, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are ULGS's sole responsibility.
17.5 Product claims. ULGS, not Apple, is responsible for addressing any claim by you or any third party relating to TelCam or your possession or use of it, including product liability claims, any claim that TelCam fails to meet a legal or regulatory requirement, and claims arising under consumer protection or similar law.
17.6 Intellectual property claims. If a third party claims that TelCam, or your possession and use of it, infringes that party's intellectual property rights, ULGS, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.
17.7 Legal compliance. The representations and warranties you make in section 11 apply.

17.9 Third-party terms. You must comply with any applicable third-party terms when using TelCam, as stated in section 3.
17.10 Apple as third-party beneficiary. You and ULGS acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and that on your acceptance of it Apple has the right — and is deemed to have accepted the right — to enforce this Agreement against you as a third-party beneficiary.
17.11 Positioning on Apple devices. TelCam contacts no service and cannot transmit anything by itself. Unlike the Android version, which declares no internet permission, this is a property of how TelCam is built rather than of the platform, and ULGS verifies it against each release.
Entire agreement. This Agreement, with the privacy policy referenced in it, is the whole agreement between you and ULGS about TelCam, and replaces any earlier understanding.
Severability. If a provision is held unenforceable, it is limited or severed to the minimum extent necessary and the rest stays in force.
No waiver. If we do not enforce a provision, that is not a waiver of it.
Assignment. You may not assign this Agreement. We may assign it in connection with a merger, sale of assets, or similar transaction.
Your store's terms. You obtained TelCam through an app store, and that store's terms govern your purchase, billing, and refunds. On Google Play, this Agreement is between you and ULGS only; Google is not a party to it and has no obligation or liability under it. On the Apple App Store, section 17 applies.
